Terms and Conditions of Use

1. Not a Diagnostic Tool

SCRS is a predictive risk-assessment and screening system and does not diagnose coronary artery disease, myocardial infarction, stroke, or any medical condition.

• It must not be relied upon as a standalone diagnostic instrument.
• SCRS does not replace clinical evaluation, diagnostic tests, or a registered medical practitioner’s judgment.

2. No Medical Advice

SCRS does not provide medical advice, therapeutic recommendations, or prescriptions. Output generated is for general informational purposes only. Users must consult a qualified, registered medical practitioner before taking any health-related decisions.

3. Risk Estimate Only

SCRS provides a probability-based risk estimate, not a medical certainty.

• A low score does not guarantee absence of disease.
• A high score does not confirm the presence of disease.
• False positives and false negatives may occur due to inherent limitations of risk-prediction tools.

4. Telemedicine Services (Safe Harbor)

This section applies to users engaging with Registered Medical Practitioners via the platform.

4.1 Nature of Services (Intermediary Status)

The App acts solely as a technology facilitator and "Intermediary" that connects Users (Patients) with Registered Medical Practitioners (Doctors). The Company does not provide medical services, healthcare advice, or medical diagnoses. The Doctors listed on the Platform are independent practitioners and are not employees of the Company.

4.2 No Doctor-Patient Relationship with Platform

The use of the App does not create a Doctor-Patient relationship between the User and the Company. Any medical advice, diagnosis, or prescription provided via the App is solely the responsibility of the consulting Doctor. The Company is not a party to the medical interaction between the Doctor and the Patient.

4.3 Limitation of Liability

To the fullest extent permitted by law, the Company disclaims all liability for:

• Any medical errors, negligence, or professional misconduct by the Doctor.
• The accuracy, validity, or effectiveness of any prescription issued by the Doctor.
• Adverse drug reactions or side effects resulting from medication prescribed via the App.

The User acknowledges that the Company is an 'Intermediary' as defined under the Information Technology Act, 2000, and enjoys protection under the Safe Harbor provisions of Section 79 of the Act.

5. Dependency on User & Third-Party Data

SCRS results depend on user-entered information, laboratory test reports, and imaging reports provided by external centres. Swizton Medtech is not responsible for errors, inaccuracies, or omissions in data provided by the user or third-party service providers.

6. Laboratory & Imaging Responsibility

Laboratory tests, sample collection, and CT imaging are performed by independent third-party entities. Swizton Medtech does not control and is not liable for:

• Sample collection quality
• Test methodology
• Imaging procedures or acquisition quality
• Reporting accuracy

Any disputes regarding test results must be addressed directly with the respective provider.

7. Clinical Pathway Limitation

The risk-based pathways (low / intermediate / high) are indicative in nature. Decisions regarding further investigations, medications, interventions, and hospitalization must be taken exclusively by the user’s treating physician.

8. Emergency Disclaimer

SCRS is not intended for medical emergencies. SCRS does not provide real-time emergency services.

In case of symptoms such as chest pain, breathlessness, fainting, sudden weakness, or neurological symptoms, the user must seek immediate emergency medical attention.

9. Limitation of Liability

To the fullest extent permitted under Indian law, Swizton Medtech, its directors, founders, advisors, employees, partners, and affiliates shall not be liable for:

• Medical outcomes
• Clinical decisions based on SCRS outputs
• Delayed diagnosis or missed diagnosis
• Health deterioration, complications, or death
• Actions taken or omitted based on SCRS scores

Use of SCRS is entirely at the user’s own risk.

10. No Guarantee of Outcomes

SCRS does not guarantee prevention of cardiac disease or reduction of adverse cardiac events. Health outcomes depend on multiple personal, clinical, lifestyle, and genetic factors beyond the scope of SCRS.

11. Population-Level Tool

SCRS is designed for population-level screening and stratification. It may not be valid for children, pregnant women, or individuals with known advanced cardiovascular disease unless used under medical supervision.

12. Data Privacy, Consent & Use

By using SCRS, the user consents to:

• Collection, processing, and storage of relevant personal and health information.
• Use of anonymized and aggregated data for research, algorithm improvement, and validation.

Swizton MedTech will handle personal data in accordance with applicable Indian data-protection laws and internal privacy policies. Swizton MedTech does not sell or disclose personally identifiable information to external parties except as required for operations or by law.

13. Algorithm Updates

SCRS algorithms, thresholds, and recommendations may be periodically updated based on clinical evidence, advisory board recommendations, validation studies, or regulatory/compliance changes. Updated versions may alter previously generated scores.

14. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes arising from the use of SCRS shall be subject to the exclusive jurisdiction of courts in India, unless otherwise specified by applicable law.

15. Acceptance of Terms

By accessing or using SCRS, the user acknowledges that they have read, understood, and agreed to be bound by these Legal Disclaimers and Conditions of Use. If the user does not agree, they must discontinue use of the SCRS platform immediately.
